Misdemeanor & Felony Charges in Nebraska

There are two main types of crimes in Nebraska: misdemeanors and felonies. Misdemeanors are considered less serious than felonies.

However, a conviction for a misdemeanor can result in jail time, fines, and other serious criminal penalties. Additionally, having a misdemeanor on your criminal record can make it difficult to obtain employment and housing.

The following are the classes of misdemeanors in Nebraska and the associated penalties:

  • Class I misdemeanor – Punishable by a maximum jail term of one year and a fine not exceeding $1,000

  • Class II misdemeanor – Punishable by a jail sentence of up to six months and a maximum fine of $1,000

  • Class III misdemeanor – Punishable by maximum jail term of three months and a fine no more than $500

  • Class IIIA misdemeanor – Punishable by a jail sentence of up to seven days and a maximum fine of $500

  • Class IV misdemeanor – Punishable by a maximum fine of $500

  • Class V misdemeanor – Punishable by a fine not exceeding $100

  • Class W misdemeanor – Punishable by a maximum jail term between 60 days and one year and a fine ranging from $500 to $1,000, depending on the defendant’s criminal history.

While a Class I misdemeanor carries a jail term of up to one year, felonies are punishable by more than a year in prison. A felony conviction can also lead to the loss of your gun rights and voting rights.

The classes and penalties of Nebraska felonies include:

  • Class I felony – Death penalty

  • Class IA felony – Life imprisonment

  • Class IB felony – Prison sentence between 20 years and a life sentence

  • Class IC felony – Prison sentence between a mandatory minimum five years and a maximum 50 years

  • Class ID felony – Prison sentence between a mandatory minimum three years and a maximum 50 years

  • Class II felony – Prison sentence between one year and 50 years

  • Class III felony – Prison sentence between one and 20 years, as well as a maximum fine of $25,000

  • Class IIIA and Class IV felony – A maximum five-year prison term and a fine no more than $10,000
